Since 3DS software licenses are device-specific, you cannot access the downloaded games on both systems after the transfer -- you are transferring the licenses from one device to the other. If you're transferring data to a brand-new New Nintendo 3DS or 3DS XL, you have the choice of using the included 4GB Micro SD Card or getting yourself a larger one before starting the process.

*My 3DS bit the dust a few months back. Rather than pay for Nintendo to fix it, I waited for the New 3DS. Unfortunately, most of my games were purchased digitally, and you can't just insert an old.

They can run commercial DS games, DSi games and DS Homebrew Apps on 3DS, but are not currently able to run 3DS ROM backups. Most likely for N3DS games we will need a new generation of R4 3DS flash cards.What you need to know before transferring:
- You must have both Nintendo 3DS units to complete the license transfer. You cannot back up the data and just sell the old one and expect the data to work on your New 3DS. If you no longer have access to your old 3DS, you have to call Nintendo customer service and see if they can help you recover your games as the licenses are still tied to the old system.
- Some retailers, such as GameStop have special permissions when letting owners trade in their old 3DS when buying a new one. Many stores let you complete the trade-in offer for credit after the purchase and transfer. Make sure to ask.
- Originally, Nintendo had limited the maximum number of times that you could transfer licenses/move data from one 3DS to another but has since then removed that limitation. So you can upgrade without any worries. There is, however, a seven-day transfer lock-out; so you can only do one transfer a week.
- You cannot transfer data from a New 3DS / 3DS XL to a standard 3DS. However, you can contact Nintendo customer service and have them do the transfer for you.
- When you first boot up your New 3DS, you should NOT create a new Nintendo Network ID (NNID). The NNID from your old 3DS will overwrite any NNID on the New 3DS.
- The transfer will move your downloaded content, save data, your NNID (if used), friends list, Nintendo eShop balance, and purchase history (including themes).
- Any preinstalled software on the new device can be redownloaded from the eShop without the need of an NNID. It is pre-registered to the device ID -- thus, you can just sign in to the eShop and redownload it even on a fresh, new microSD card. So you will not lose, say, Monster Hunter 4 on the MH-themed New 3DS, due to a transfer.
There are three ways to transfer data. Which choice works best for you depends on how many games/data you have on your original 3DS and what kinds of equipment and time you have.
*Wireless Transfer: select this if you have only few games on the original system and/or you're in no rush and want a simple transfer process without redownloads or computer transfers.
*Wireless Transfer to Smaller microSD Card - aka 'redownload everything': choose this option if you want to transfer all the software licenses, but not necessarily download and install all the games at this point. This is a good option if your target system's SD card is smaller than your original system's (eg: your 3DS has a half-full 16GB SD card and your New 3DS has the standard 4GB microSD card). Also, you have to click a lot of redownload buttons..
*Transfer Data Using a PC: this is the fastest and most reliable process, but it requires a PC or a Mac with an SD Card reader. MicroSD cards are usually sold with an SD card adapter that fits into a standard reader. This option requires you to open the back of the New 3DS to take out the microSD card. It's a simple maneuver, but it requires a screw driver. If you have a New 2DS XL, the Micro SD card slot is located beneath the save cover that protects the game card slots. Note: The first option is the slowest and easiest, the last option the fastest but most difficult one. The choice is yours.
In all cases, if you want to use a bigger than 4GB MicroSD card, you can insert it before you start the process even if your new 3DS comes with a preinstalled game as is sometimes the case with bundles. If your bundle doesn't have a download code or physical cart included, you'll just have to redownload the game again after the swap. If you have a slow internet connection, you might want to choose to do a regular transfer first before you upgrade to a bigger microSD card to avoid having to download again. Either way, since the installed game's license is registered to the device, it will not be lost with a card swap. Just make sure to not create a new NNID when you start the new system. Go straight to the transfer or card swap.
To swap the memory card in your New 3DS, you have to use a small Phillip's-head (cross-head +) screwdriver to gently loosen the two screws on the back of the 3DS (they don't come out -- just turn counter-clockwise until you sense the 'click' that signals they're loose), then pry on the small slots to the sides with the back of the stylus as shown. If you press gently, you can feel the cover separating. Carefully open the 'hood' by lifting it and pulling gently forward to take it off. Replacing it afterwards is easy -- just make sure it's all lined up perfectly.1. Wireless Transfer[edit]
*Turn on your Nintendo 3DS and New Nintendo 3DS. Make sure both devices are plugged in and both have SD Memory Cards in them. The transfer process can take a long time, so make sure you don't run out of batteries.
*Do not create a new NNID (Nintendo Network ID) on your new system if you're transferring from another one. After the basic setup, go straight to the next step.
*Access System Settings (the wrench icon), then Other Settings, on both units. Make sure both systems are connected to the internet, via WiFi.
*Tab to the right in the Other Settings menu and select System Transfer. The systems will connect to the internet.
*Select Transfer from a System in the Nintendo 3DS Family on both machines.
*On the new system that you want to move the data to (Target System), select Receive from Nintendo 3DS.
*On the system that you are transferring data from (Source System), please select Send from this System.
*Follow the prompts on both devices choosing the right selection (3DS to New 3DS), select Move, and wait for the transfer. This can take a while since all data is being moved wirelessly.
*If you had a DSiWare installed on the original 3DS, the system will prompt you and copy it from memory to the SD Card to be transferred. Make sure to complete these steps or you could lose those titles.
*Once complete, the devices will ask if it's okay to restart. Select Yes.
*If you had a preinstalled game on the new system prior to the transfer, you may need to redownload it from the eshop.2. Wireless Transfer to Smaller microSD Card[edit]
*Follow the same steps as above up to step 7 or so, but pick the second transfer option when presented 'Wireless Transfer to Smaller microSD Card'
*Instead of the lengthy data transfer, the system will transfer basic data and licenses only.
*After the process is complete, go to the eshop section (shopping bag icon).
*Select Menu and then Settings/Other
*Scroll down to Redownloadable Software and select it.
*You can now download all titles one by one by hitting the redownload button. Choose the download later option to build a queue.3. Transfer Data Using a PC[edit]Note: if you were using a microSD card with an adapter in your original 3DS, you don't need to copy any data. You can just use the original microSD card (without adapter) in the New 3DS -- unless you want to upgrade your card to a bigger size. What you need:
*A computer (PC or Mac) with either a built-in SD card slot or an SD card reader (sold separately).
*A small cross-head + screwdriver. Use a #0 size or other small screwdriver so that you don't damage or strip the screws.
*Initiate the transfer process as with the steps above in through step 7 of the Wireless Transfer guide, but pick the third option, 'Transfer data using a PC' instead.
*Follow the prompts. If you have DSiware (such as Four Swords) installed, it'll have to save the data to the SD Card for the transfer. Your 3DS will automatically prompt you for this action; follow the steps until it tells you to take out the memory cards.
*Remove the SD card from the right side of your source system, the 3DS or 3DS XL. You can simply open the hatch with your fingernail, push in the card, and it'll pop out.
*Put the SD card in your computer's SD Card reader. Find the icon / drive on your desktop/menu/finder and open it. Create a folder on your computer (label it something you'll remember, like '3dsbackup') and copy the contents of the SD Card to it. You have backed up the contens of your source system.
*Take the SD Card out and put it back in your source system.

*Remove the microSD card by pushing it in and taking it out of the target New 3DS System. If you're using a new card instead of the 4GB one included with the New 3DS, use that one instead for the next steps.
*Place the card in the SD Card adapter then put the microSD Card with the SD Card adapter into your computer's SD slot/reader. Find the icon/drive on your computer and now copy the contents of your '3dsbackup' folder (without that folder) to the new microSD card.
*When it's complete, put the microSD card back into your New 3DS (without the adapter). Replace the cover and make sure it lines up correctly before tightening the screws.
